The Freedom of the Seas or The Right which Belongs to the Dutch to Take Part in the East Indian Trade. Translated with a Revision of the Latin Text of 1633 by Ralph van Deman Magoffin. Edited with an Introductory Note by James Brown Scott. Originally published: New York: Oxford University Press 1916. xv 79 79 81-83 pp. Main text paged in duplicate with translation and original Latin text on facing leaves total 182 pp. Reprinted 2001 2017 by The Lawbook Exchange Ltd. ISBN-13: 9781584771821; ISBN-10: 1584771828. Hardcover. New. $22.95 Translation of Grotius' work Mare Liberum with Latin and English on facing pages. This groundbreaking work was commissioned by the Dutch East India Company to dispute the monopoly on East Indian trade routes claimed by the Portuguese. It argues that the seas are international territory open to all nations thus rejecting the idea that any area of the seas could belong to a country. An instant classic it received a great deal of attention when it was published in 1609. Perhaps the most important reply is John Selden's Mare Clausum 1635 which defends British claims to sovereignty over the coastal waters of the British Isles. HUGO GROTIUS 1583-1645 a pre-eminent contributor to international legal doctrine was an influential Dutch jurist philosopher and theologian. Grotius is also known for De Jure Belli ac Pacis On the Law of War and Peace originally published in 1625 which is widely considered to be the first master treatise on international law and De Jure Praedae 1604 in which he argues against territorial sovereignty of the seas. unknown

GROTIUS Hugo & William Evats trans.
The Most Excellent Hugo Grotius His Three Books Treating of the Rights of War & Peace.
London: for Thomas Basset and Ralph Smith 1682. The foundation of international law Folio 319 x 197 mm. Contemporary calf spine lettered in gilt. With the additional engraved vignette title page with portraits of Grotius and Evats by Thomas Cross title page printed in black and red. A few contemporary manicules in margins. Joints cracked but firm light wear to extremities patch of discreet repair to calf on rear cover light insect damage to calf front pastedown peeling small chip without loss to engraved title a few trivial chips to pages never affecting text dampstain at head throughout varying in severity and in places making the paper a little friable. A very good copy. First complete English edition of the Dutch philosopher jurist and theologian's legal masterpiece De Jure Belli ac Pacis Libri Tres first published in Paris in 1625 here in the English translation of William Evats c.1606-1677. There had been one previous English translation prepared by Clement Barksdale 1654 which was considered by later translators a "small and worthless abridgment" Nolan and Robertson p. 190. Grotius's treatise is considered to be the first expression of the "droit naturel" the first theorisation of "just war" and the foundation of modern international law; it had a profound influence on eighteenth-century political theorists such as Locke as well as on the arguments which supported the Glorious Revolution and the American Revolution. In his treatise Grotius puts forth his definitions of war and natural law Book I then argues for the identification of three just causes for war Book II and finally examines whether war and its combatants are bound by rules Book III. "The questions which he put forward have come to be the basis of the ultimate view of law and society. This was the first attempt to lay down a principle of right and a basis for society and government outside Church or Scripture" PMM. Goldsmiths' 2491; Kress 1557; Ter Meulen & Diermanse 630. See Printing and the Mind of Man 125; Donal Nolan and Andrew Robertson Rights and Private Law London: Bloomsbury 2011. London: for Thomas Basset and Ralph Smith, unknown
