Front fixed endpaper bears bookplate of the Rev. J. Congreve Overslade. John Congreve opened Overslade private classical school near Rugby England by 1854. In the 1860s George Farncomb Wright became his partner in the school; they dissolved their partnership for "the tuition of young gentlemen" in 1871. The Backwoods of Canada was by English author Catherine Parr Strickland Traill 1802-1899 who emigrated to Upper Canada with her husband and sister in 1832. It was one of the first in the genre of Canadian nature essays and the first of several books she wrote about her new land. Fearon had a favorable impression of America when he set out in search of a suitable location for a group of English families to settle. But as he explored he "became disillusioned by slavery the high cost of property and the lack of cleanliness generosity liberality and comprehension of liberty or honor.and advocated emigration for few Englishmen other than mechanics small farmers and poor people" Hubach p. 49. He provides much interesting detail and commentary on social conditions wages and trades rents taxes natural resources and the cost of clothes and other goods in the various locales he visited which included New York Boston Philadelphia Washington Ohio Kentucky the Illinois Territory and New Orleans. Hubach p. 68 comments that Hamilton "had a good sense of humor but he echoed Mrs. Trollope's satirical tone and warned England against imitating American institutions although he admitted he might be guilty of English prejudice." This title is often confused with a book published in 1836 in France by Baron von Holbach; Holbach's book is anti-organized religion and Trenchard's is not; Trenchard was a former Quaker who theorized that 'transports' etc. attributed to God are owing to natural causes. Title page mistakenly attributes this title to John Locke the reason for this is unknown; we found a list of books misattributed to Locke in a Locke bibliography but this is not on it. This is a chapbook about 3in x 5in recently bound in nice leather with marbled endpapers; new binding is near fine the chapbook only good original covers discolored stained rubbed and chipped; chip and tear to side edge of chapbook front cover closed with non-acidic Filmoplast P; many pages have been turned down and most have worn creased corners; pages stained and darkened; stain to top edge and foreedge; foreedge stain mostly visible on p51-52; corners of rear blank flyleaf torn off; 52pp. <br/> <br/> A. Assembled by an unknown attorney or law clerk the 19 items in this volume a 2-part transcript 15 briefs an oral argument and the opinion of U.S. Supreme Court Justice Owen J. Roberts form a documentary record of Owens v. Butler 297 U.S. 1 1936 the case that brought about the demise of the Agricultural Adjustment Act of 1933. Part of Roosevelt's New Deal this was a Federal law that aimed to raise the value of crops by paying farmers and ranchers to reduce production. The money for these subsidies was generated through an exclusive tax on companies that processed farm products. This led to a series of seven suits by processors who believed they were being taxed unfairly. The most important of these was Owens v. Butler. As framed by the plaintiff's lawyers it asserted the right of a taxpayer to question the validity of a Federal tax. The Court decided in favor of Owens ruling that the taxes instituted under the 1933 Agricultural Adjustment Act were unconstitutional under the Tenth Amendment. As argued by Justice Roberts the tax was not valid because it was established in conjunction with coercive contracts with proceeds earmarked for the benefit of farmers complying with the prescribed conditions. The court also held that the basic premise of the act paying a farmer to produce less to manipulate prices went beyond the powers of the national government. The issues raised by Owens v. Butler were addressed by the Agricultural Adjustment Act of 1938 which continue. unknown books
