Philosophical and political study on despotism and its effects it pretents to refute the theories of Rousseau while the author in reality attacks straight forward the government. Still to the point remains his remark that: 'La nation finit toujours par être plus puissante que le tyran lorsque le pouvoir arbitraire parvenu à son dernier délire a dissous tous les liens de l'opinion et épuisé les ressources que la terre offre à ceux qui la cultivent en liberté. Ainsi les hommes se vengent tôt ou tard.' 'Dans cet insolent libelle, intitulé Essai sur le Despotisme, sous couleur de réfuter les théories de Jean-Jacques sur la bonté naturelle de l'homme, l'auteur s'attaquait de front aux pouvoirs' (Duc de Castries, Mirabeau, p. 105). Initially published in two volumes in 1946 this work is Montgomery's first-hand account of his military commands during World War II such as the Western Desert campaign which ensured his reputation as one of Britain's greatest military leaders.</p><p>"Bernard Law Montgomery 1st Viscount Montgomery 1887-1976 was a British general in World War II. Educated at Sandhurst he distinguished himself in World War I and remained in the army becoming known as a tough and efficient leader. In August 1942 Prime Minister Winston Churchill appointed him commander of the British Eighth Army in North Africa which had recently been defeated and pushed back to Egypt by German General Erwin Rommel. He commanded the British army in the North Africa Campaign and forced the German retreat from Egypt after the Battle of El Alamein 1942. He commanded troops in the Allied invasion of Sicily and Italy 1943 and in the Normandy Campaign leading the British-Canadian army group across northern France and into northern Germany. Following World War II Montgomery was made a knight of the Garter and was created 1st Viscount Montgomery of Alamein in 1946. He became chief of the imperial staff 1946–48 and later deputy commander of NATO 1951–58. A cautious thorough strategist "Monty" often exasperated fellow Allied commanders including Dwight D. Where Salmasius defended Charles II, Milton defended the right of the people to try and execute an unjust king. 'Claude Saumaise (1588-1658), l'un des plus célèbres érudits et critiques du XVIIe siècle. Il embrassa le protestantisme, alla s'établir à Leyde (1631), où il succéda comme professeur à Joseph Scaliger. One of various editions published in the year as its original publication in folio which was also published by the Elzeviers, and often reprinted. This is the work by which Salmasius is best remembered. It does not appear by whose influence he was induced to undertake the Defensio Regia, but Charles II defrayed the expense of printing, and presented the author with £ 100. A View of the Evidence for Proving That the present Earl of Galloway is the Lineal Heir-Male and Lawful Representative of Sit William Stewart of Jedworth so frequently mentioned in History from the Year 1384 to the Year 1429.

A scarce argument for the inheritance of John Stewart 7th Earl of Galloway 1736-1806 to give him a claim to the English peerage. Lord Galloway had already sat in the House of Lords as a Scottish representative peer and had done so since 1774 but faced re-election each parliament and lost his seat in the 1790 election. Whether on the strength of this argument or his service as a Lord of the Bedchamber Lord Galloway achieved his aim being created Baron Stewart of Garlies in the peerage of Great Britain in 1796 and thereby rejoining the Lords as a permanent member. Though anonymous this pamphlet was written by Eliezer Williams 1754-1820 chaplain and tutor to the Galloway family who had been enlisted to help investigate the pedigree. The table at the end mentions the death of Vice-Admiral Keith Stewart in March 1795 giving a terminus post quem for the publication. NLS and Hornel Gallery only in ESTC. ESTC T193376. A scarce pamphlet arguing the case of Hugh Leslie of Powis 1758-1812 a justice of the peace against a number of landowners who had brought criminal proceedings against him for in his description having improved at his own expense a public road that the others claimed to be in their private ownership - the actual charges being trespass damage of a fence and theft of ploughed black mould from the roadside. Leslie felt the principles involved important enough to publicise the matter widely - the final page indicates that the pamphlet is ‘to be had of all the Bibliopolists in the United Kingdom’ priced sixpence and he also published in the same year a work of over 300 pages titled ‘Hot Pressed Doctors Outwitted’ covering the affair in exhaustive and obsessive detail. An indictment against James Fyfe on behalf of Patrick Duff alleging perjury in his oath before voting in the contested Banffshire by-election of 1795. Duff was opposed to the Earl of Fife’s control of the electoral roll and stood against the Earl’s candidate in the by-election but lost. The dissolution of Parliament for a general election looming instead of submitting a petition to Parliament challenging the result Duff instead brought this private prosecution against Lieutenant James Fyfe of Edinglassie one of the electors. The by-election is the subject of an article by Alistair Mutch ‘A Contested Eighteenth-Century Election’ Northern Scotland vol. 2 pp. 22-35 based on the records of it in the National Archives though no copy of this printing has been traced elsewhere. A substantial transumpt a formal copy or transcript of a document made for parties to a litigation totalling around 18000 words covering a dispute over ownership of land in Aberdeen between Magnus Mowat and William Cruickshank an Aberdeen merchant. The document provides information about the history of ownership of the relevant land mentioning other parties including the University of Aberdeen and the Leslie and Bruce families. It was produced on behalf of Alexander Thomson town clerk of Aberdeen who signs the foot of each page and who held that position between 1694 and 1713. It proposes an amendment to the inheritance law of Scotland with particular reference to the Entail Act 1685 a much-amended act which ‘related to a subject which affected very materially the welfare not only of landowners but of tenants and the public generally in Scotland’ according to Lord Advocate Edward Gordon seeking a further amendment in 1875. Ordered that the appeal be Dismissed and the Interlocutors Complained of be Affirmed.’ An appeal to the House of Lords in the case of the Earl of Aboyne against the Earl of Aberdeen over the behavior of the arbiter John Innes factor to the Earl of Fife. The two Earls had seen frequent border scuffles including the construction and destruction of livestock shelters in their estates in Cromar Aberdeenshire and consequently employed an arbiter to settle disputes as they arose. Aboyne complains of the arbiter’s decisions and Aberdeen responds in kind; this copy bears an annotation of the decision in favour of the latter. A printed indictment against Andrew Macghie of Edinburgh for armed robbery. Macghie is charged with purchasing a pistol under guise of intending to travel to Glasgow but instead using it to assault and rob James Ferrier Writer and Patrick Graeme Advocate in separate instances near the Canongate in December of 1769. It concludes: ‘All which. being found proven by the verdict of an assize. you ought to be punished with the pains of law to the terror of others to commit the like crimes in all time coming’. There is then appended a list of witnesses beginning with the victims but stretching to over two dozen further names and a list of the members of the assize i.e. jury in Scots law among which are a number of booksellers and bankers including Sir William Forbes from whose collection this copy originates. The widow of Andrew Fletcher of Saltoun 1722-1779 grand-nephew of the noted patriot and book collector inherited a significant sum upon her first husband’s death though the majority of the estate went to his brother. But her second marriage was less fortunate: Lewis Gordon turned out to have been bankrupt and when his estate was sequestered to pay his debts his new wife’s property was included leaving her penniless. The case outlined in this rare pamphlet not listed in ESTC or Worldcat against Gordon and his factor and accountant alleges fraud; they appealed and the legal battle stretched on at least through 1787. The tenants challenged portions of their tithe some of which was not explicitly mentioned in the mill’s original charter of 1612 while the owners contend that they only ‘demand from what any of the Sucken more than what had been immemorially and uniformly paid’. The opening salvo in a substantial case of electoral fraud and misrepresentation in the county of Moray between two groups represented by Sir Alexander Penrose Cumming later Cumming-Gordon 1st Baronet 1749-1806 on one side and here on the other William Leslie Minister of the Parish of St Andrews and Longbride sparked by the election of spring 1784. A group of freeholders in Elgin and Forres argue that the electoral roll has been fraudulently increased from 22 ‘real freeholders’ to 65 and therefore for several elections past the wrong candidate has been elected. In the 1784 election Penrose-Cumming lost to James Duff Earl of Fife who it is claimed formed ‘a troop of fictitious voters’ by giving; this case targets William Leslie who swore under oath that he owned parts of Kinnedar but did so under arrangement with Duff. Other ‘fictitious voters’ had withdrawn under pressure but Leslie fought the case arguing against Penrose-Cumming’s standing to bring the case and the claim against his freeholding. BL only in ESTC.
