New. $44.95 The life and works of Charles Dickens were permeated by lawyers and the legal system. As a boy he endured his father's imprisonment for debt. At 17 he became a solicitors' clerk. At 19 he became a court reporter and later a parliamentary reporter. As a successful author he engaged in litigation to protect his copyright and campaigned for law reform. He had numerous friends and acquaintances in the legal world and near the end of his life his son Henry chose to follow a career at the bar. Most of Dickens' novels have legal themes and lawyers that are usually portrayed with his dark and ironic humour. Dickens' personal involvement and fictional creations within the legal world are drawn together and put into context by an author who has spent a career practicing as a lawyer in central London. He brings an in-depth knowledge and experience of a legal world that still reflects the one known to Dickens. This includes its lawyers clerks judges courts offices and ancient inns of court. This book is partly biographical and partly a study of the Victorian legal world based on the many descriptive extracts from the novels. The legal characters are examined in detail with extensive quoted passages providing an entertaining anthology and a useful work of reference. Paul Howcroft studied law at Trinity Hall University of Cambridge. He is an English solicitor advocate specialising in civil litigation who practiced in central London throughout his career as a partner in firms in the City of London and Holborn. One of three 1753 London editions for which priority has not been established. In the course of the War of the Austrian Succession Britain seized several Prussian merchant ships on the grounds that they were carrying enemy property. English admiralty courts partially restored the ships and goods but declared the rest legitimate prize. The King of Prussia dissatisfied with this outcome had the British admiralty cases rejudged by a Prussian commission; when the commission found the British ruling illegitimate Prussia prepared to economically retaliate. This report was commissioned in response to the situation. Described as "one of the ablest clearest and most conclusive state papers that has ever been published" and "characterised by Montesquieu as a reponse sans replique" it "completely annihilates every statement and pretence by which the Prussian Government attempted to justify their proceedings" McCulloch. A significant work in the history of prize law it established the principle that enemy goods can be seized on neutral vessels. McCulloch The Literature of Political Economy 117. Legal Machines: Of Subsumption Automata Artificial Intelligence And the Search for the "Correct" Judgment. Clark New Jersey: Talbot Publishing 2023. x 167 pp. ISBN-13: 9781616196813. ISBN-10: 1616196815. Hardcover. New. $125. A title in the JCL Studies in Comparative Law Second Series. As advances in artificial intelligence grip our imagination in the twenty-first century Meder reminds us that law's first "machine age" dates from at least the seventeenth century and the inventive minds of Jean Bodin and Thomas Hobbes. Jurists involved in finding legal decisions would be merely a cog in a large apparatus designed to give expression to the will of the sovereign through the proper application of the law. The nineteenth century declared war on the absolute monarchical state and the mechanistic paradigm. The critique of a "mechanical" application of law and the distorted image of the "subsumption automaton" have stood for criticism of judging that removed from the demands of "everyday life" adheres to predefined concepts and dispenses with reflection on law and justice. Rudolf Jhering's "judgment machine" Hermann Kantorowicz's "thinking machine" or Max Weber's "paragraph automaton" can be seen as pejorative images of a machine into which "one throws the files at the top together with costs and fees so that it spits out the judgment at the bottom along with the more or less valid reasons." Digitization is transforming the means of delivery and providing greater sophistication but Meder's study is a thorough and pioneering reminder that people today are seeking new routes to a long-cherished and not necessarily desirable outcome. Stephan Meder is professor for Civil Law and History of Law at the Gottfried Wilhelm Leibniz Universitat Hannover and a leading authority on artificial intelligence and the law. Verena Beck is a professional freelance translator based in Germany. unknown books
