1956ref. 184698Pretoria: The Government Printer 1956. A major moment in South African history First edition of the indictment for the "Treason Trial" in which Nelson Mandela and almost the entire anti-apartheid leadership were prosecuted. One defendant Ahmed Kathrada has signed beside his name; the signature was acquired by a collector in recent years. "The core of the treason charge related to a momentous - and for the government disconcerting - event at Kliptown on the outskirts of Johannesburg on 25-26 June 1955. The delegates were drawn from the ranks of the Congress Alliance a coalition of race-based anti-apartheid groups - the ANC still Africans only the Indian Congresses the Coloured People's Congress and the white mix of communists and non-communists. They had come together to draw up the country's first democratic constitution. Out of the deliberations came the endorsement of a Freedom Charter which to western eyes was an unexceptionable statement of democratic principles and equal rights owing something to the UN Charter but virtually nothing to the Communist Manifesto" Herbstein pp. 28-9. In response 156 individuals who attended or were associated with the meeting were arrested under the 1950 Suppression of Communism Act. The trial helped unite the anti-apartheid movement and attracted worldwide support for the struggle and international condemnation of the South African government. The trial lasted over four years after which all the accused were acquitted. However soon after Mandela and other defendants were imprisoned following the Rivonia Trial. 3 vols bound in 1 as issued folio. 1961139, 5 [ads] pages. Black and white photos. Critically annotated on many pages by prior owner who applied a masking tape label to the front cover upon which to state his disagreement with the content. Annotation on page 101 suggests prior owner served in the air force of an allied country during WWII. Notes on title page document the development of this person's revisionist view of WWII from 1945 through 1995. Heavy wear. Binding open at page 81. One page of photos loose but present. In short, a poor but intriguing copy. Book

1807ref. 708151807. I Am Inclined to Give Credit to Her Assertions": An Irish Magistrate's Defense of an 1807 Rape Victim Manuscript. Trial. Ireland. Account of a Rape. County Carlow Ireland June 25 1807. 11" x 7" 27.9 x 17.8 cm leaf docketed on verso. Single leaf manuscript on paper measuring 11" x 7" 27.9 x 17.8 cm. Unbound as issued with contemporary legal docketing and extensive manuscript annotations by the presiding magistrate to the lower margin of the recto and across sections of the verso. Light horizontal folds from period mailing/filing mild uniform browning and light wear along the edges otherwise remarkably fresh and completely legible throughout. $1500. A powerful and hauntingly detailed original sworn manuscript record detailing an account of sexual violence in rural County Carlow paired with a rare candid commentary by the presiding local magistrate regarding the legal competence and credibility of the female victim. Taken before Gilbert Fitzgerald a prominent local Magistrate of the Peace this manuscript records the direct testimony of Margaret Janson regarding an assault by Myles Barin. The body of the information vividly captures the victim's contemporaneous narrative: "Myles Barin opened his small cloths informant asked him what he was going to do to her he answered he would ride her then extending her legs and endeavouring to force something into her body and struggled with her near an hour." In 19th-century Irish and British common law victims of sexual crime faced formidable legal obstacles often compounding the trauma of the assault itself. Female testimony was frequently met with deep skepticism stringent requirements for physical corroboration and strict adherence to oaths that marginalized uneducated or illiterate witnesses. What elevates this document from a routine legal record to a remarkable artifact of historical criminal justice is Magistrate Fitzgerald's handwritten commentary appended directly to the foot of the document: "I did not swear Informant to this Information as she appeared to be entirely ignorant of the nature of an Oath but the facts are strongly corroborated by other evidence and I am inclined to give credit to her assertions." Fitzgerald's willingness to bypass strict procedural religious swearing while explicitly validating Janson's truthfulness. unknown
