Report of the Committee of Claimson the Petition of Alexander Fowler
Philadelphia 1796. First edition. 5pp. 8vo. Single large sheet printed and folded with top edges remaining uncut. Light staining. Fowler has petitioned for his 1763 claim from King George for 10000 acres in the territory north west of the Ohio to come to fruition. Fowler had supposedly been a military officer and was given a right in any of the then British provinces on the continent of North America. The committee seems to be hemming & hawing and they state that Fowler has not seemingly tried to obtain lands nor is there proof that he was indeed a reduced officer. Seems the Committee is placing Fowler in a paperwork catch-22 as he probably could not obtain land without their say so. Evans 31399 Rare. unknown

Early American Imprints 2nd series Shaw & Shoemaker 18494. This report is part of a lengthy and complicated matter involving a Revolutionary War privateer Gideon Olmstead who fought for over three decades for a larger share of a British ship taken during the war and Elizabeth Sergeant & Esther Waters the daughters and heirs of David Rittenhouse Pennsylvania's treasurer during the Revolution. Rittenhouse had been charged with protecting the prize money until the matter was resolved. However even after federal courts ruled in favor of Olmstead Pennsylvania refused to relinquish its claim to the money. In 1809 the United States Supreme Court in U.S. v. Peters 9 U.S. 5 Cranch 115 1809 in a nationalistic Marshall Court decision made it the first case to strike down a state statute. In response Gov. Snyder ordered the militia "to protect the daughters of Rittenhouse" who lived in adjoining houses at Arch and 7th Streets which they did for five weeks in March and April 1809. When the U.S. Marshal John Smith tried to serve the writ he was stopped by crossed bayonets. After he entered Sergeant's house through a rear window and arrested her Gov. Snyder finally paid the sum to the marshal striking a blow to the doctrine of state supremacy. This report relates to the unsuccessful attempt to force the marshall to release Elizabeth Sergeant Pennsylvania Chief Justice William Tilghman ruling that although he thought he had the power to discharge them if the federal court did not have jurisdiction he determined that in this case the federal court did have jurisdiction and so she should remain in custody of the U.S. marshall. A very scarce early 19th-century American legal report. In Very Good- Condition: disbound; scattered foxing and soiling first several leaves are the most heavily foxed; trimmed too closely at the foot of p. 39 with slight loss of text; old dampstain along upper edge of some leaves. <br/><br/> David Hogan paperback

Every leaf of text is interleaves with a blank leaf for notes; in this volume the blank leaves remained blank. Former owner's inscription on front fixed endpaper: Warren G. Light Lebanon Pa. "Warren G. Light" is also written at head of the title page. Stamped on front free endpaper: "Meyer Brubaker & Lewis Law Offices Lebanon Pennsylvania." This was probably Alvin B. Lews esq. a grandson of Warren G. Light esq. of Lebanon Pa. Tipped onto the back free endpaper is a printed leaf with Uniform Rates recommended by the Commercial Law League of America at its 23rd Annual Convention in 1917. With loose: printed slip with from the Supreme Court of Pennsylvania with amendments to rules and the order to establish a Board of Law Examiners all dated 1902; and the carbon from the Court of Common Pleas of Lebanon County replacing rule 24 dated 1961. The Roll of Attorneys lists everyone admitted to practice in Lebanon County from 1813 through July 1895 with dates of death where relevant. An extremely scarce 19th-century Pennsylvania legal work. Patton cashier of the First National Bank of Curwensville Pa. The Second National Bank of Pittsburgh was established in 1864. James Hays Willock 1853-1907 became president of the bank in 1887. Alexander Ennis Patton 1852-1904 became the president of the First National Bank of Patton when it was established in 1893 and was elected to the Pennsylvania Senate in 1900.
