"Isaac Smith Kalloch accused of adultery in this prosecution was a Baptist clergyman and was supported by the trustees of his church throughout this affair. . The jury could not reach a verdict in the case which was tried in the Massachusetts Court of Common Pleas Criminal Session in Cambridge Massachusetts" Cohen. Kalloch was defended by the eminent lawyer and politician Richard Henry Dana Jr. 1815-1882. The Full Report includes the judge's charge but not the jury's final verdict. Kalloch moved to San Francisco where he continued to generate controversy by skirting the bounds of decency. When he decided to run for mayor of San Francisco in 1879 he came under attack from the San Francisco Chronicle's editor-in-chief Charles de Young who was backing another candidate. DeYoung hoping to end Kalloch's campaign accused the minister of having an affair. Kalloch responded by claiming that De Young's mother ran a brothel. In response DeYoung ambushed Kalloch on a street and shot him twice. Kalloch survived the wounds. Due in part to the sympathy of voters he was elected the 18th Mayor of San Francisco. 1807ref. 708151807. I Am Inclined to Give Credit to Her Assertions": An Irish Magistrate's Defense of an 1807 Rape Victim Manuscript. Trial. Ireland. Account of a Rape. County Carlow Ireland June 25 1807. 11" x 7" 27.9 x 17.8 cm leaf docketed on verso. Single leaf manuscript on paper measuring 11" x 7" 27.9 x 17.8 cm. Unbound as issued with contemporary legal docketing and extensive manuscript annotations by the presiding magistrate to the lower margin of the recto and across sections of the verso. Light horizontal folds from period mailing/filing mild uniform browning and light wear along the edges otherwise remarkably fresh and completely legible throughout. $1500. A powerful and hauntingly detailed original sworn manuscript record detailing an account of sexual violence in rural County Carlow paired with a rare candid commentary by the presiding local magistrate regarding the legal competence and credibility of the female victim. Taken before Gilbert Fitzgerald a prominent local Magistrate of the Peace this manuscript records the direct testimony of Margaret Janson regarding an assault by Myles Barin. The body of the information vividly captures the victim's contemporaneous narrative: "Myles Barin opened his small cloths informant asked him what he was going to do to her he answered he would ride her then extending her legs and endeavouring to force something into her body and struggled with her near an hour." In 19th-century Irish and British common law victims of sexual crime faced formidable legal obstacles often compounding the trauma of the assault itself. Female testimony was frequently met with deep skepticism stringent requirements for physical corroboration and strict adherence to oaths that marginalized uneducated or illiterate witnesses. What elevates this document from a routine legal record to a remarkable artifact of historical criminal justice is Magistrate Fitzgerald's handwritten commentary appended directly to the foot of the document: "I did not swear Informant to this Information as she appeared to be entirely ignorant of the nature of an Oath but the facts are strongly corroborated by other evidence and I am inclined to give credit to her assertions." Fitzgerald's willingness to bypass strict procedural religious swearing while explicitly validating Janson's truthfulness. unknown

A very good copy. $250. One of four London issues variant imprints from 1757. This scarce pamphlet details a scandalous 18th-century "Criminal Conversation" crim. con. action-the legal precursor to civil damages for adultery. The plaintiff Admiral Sir Charles Knowles accused Captain James Gambier of an affair with his second wife Maria de Bouget 1733-1796. The trial serves as a fascinating lens into the social dynamics naval politics and public consumption of celebrity scandal in Georgian England. Gambier was notoriously unpopular among his crew; one of his own men famously described him as a "penurious old reptile" Oxford Dictionary of National Biography. This deep lack of personal popularity appears to have spilled over into the courtroom. Failing to win the sympathy of the special jury Gambier was ordered to pay a hefty fine of 1000 to the plaintiff-a significant sum for the era though far short of the original 10000 demanded. 1963ref. 1059421963/1965. Light scattered staining and spotting throughout. The sole edition of a witness account of the scandalous trial of Assistant Deputy Post-Master and apothecary Arthur Wallace of Carlow Ireland indicted under the charges that 'on the 1st March in the 40th year of the King at Carlow he feloniously did secrete and embezzle a packet directed to Henry Loftus Tottenham at Ross which packet was sent by the post'. Despite the severity of the charges Wallace received countless recorded testimonies of good character being described by his own prosecution as 'a man of honour and integrity'. As such convicting Wallace of defrauding the mail required definitive evidence which was collected with the assistance of one Mr. De Joncourt described as a man 'of considerable sagacity’ and a ‘gentleman of considerable trust in the Department of the General Post Office'. In an almost-cartoonish fashion Joncourt's interrogation of the 'honest sober and industrious' Wallace revealed a great deal of repossessed banknotes in 'an inside concealed pocket' which were promptly identified as those missing from Tottenham's package. Wallace was accused of subsequently forging numerous counterfeit bills to replace those stolen and circulating them across the county; he was sentenced to death with execution ordered for the 16th of August 1800. .
