Studiare l'evoluzione del diritto in rapporto alla vita economica e sociale esclude il dettaglio della tecnica giuridica in senso stretto a meno che tale dettaglio non sia significativo di una tendenza sociale e politica. Il diritto quindi non può essere considerato, in una storia delle istituzioni, come una realtà a sé: lo studio dell'organizzazione teorica delle istituzioni non basta a darcene la realtà politica o giuridica ma mette solo a disposizione dei meccanismi o dei quadri che la vita modifica.
