br., très bon état « La détection, le contrôle et la sanction des pratiques anticoncurrentielles, autrement dit celles qui emportent une atteinte ou une menace au fonctionnement concurrentiel des marchés, ont, dès les origines du droit spécifique de la concurrence, emprunté des voies originales : enquêtes dérogatoires au droit commun, rôle déterminant de l’administration, intervention d’une institution ad hoc de nature administrative (commission technique des ententes en 1953, conseil de la concurrence depuis 1986), tels sont les principaux traits qui, à des degrés variables au fil du temps, ont toujours caractérisé les procédures qui leur sont applicables. Il en est résulté de constantes interrogations sur la légitimité comme sur les effets de ces particularités procédurales, notamment quant à leur impact sur les droits reconnus aux intéressés mis en cause. C’est dans ce contexte qu’est intervenue la réforme opérée par l’ordonnance du 1er décembre 1986 relative à la liberté des prix et de la concurrence qui eut pour objet de moderniser le fond du droit de la concurrence, mais aussi d’en rénover les procédures afin d’accroître la protection et les garanties des droits de la défense. L’étude entreprise s’attache à ce dernier objectif et tend à dresser un bilan de l’application pratique et contentieuse du nouveau dispositif. A cette fin, elle porte sur l’ensemble des procédures auxquelles peuvent donner lieu les pratiques d’entente, d’abus de position dominante, d’abus de dépendance économique et de prix abusivement bas, regroupées sous le titre III de l’ordonnance. Procédures d’enquête, en premier lieu, conduites selon des règles spécifiques par des agents spécialement habilités, mais placées sous le contrôle de l’autorité judiciaire lorsqu’est en jeu la liberté individuelle. Procédures au fond, en second lieu, engagées devant le conseil de la concurrence, dont les décisions peuvent être frappées d’un recours devant la cour d’appel de Paris, ou introduites devant les juridictions de droit commun pour que soient tirées les conséquences au plan civil et, le cas échéant, au plan pénal des pratiques en cause. »

Gerry built the first steam yacht the Electra which became the flagship of the New York Yacht Club while he also sat on hospital boards and founded the New York Society for the Prevention of Cruelty to Children which still operates today. As Dowling shows Gerry's brilliance and passion was at the heart of it all. With this book SHELLEY L. DOWLING has won the Joseph L. Andrews Legal Literature Award from the American Association of Law Libraries for the second time. In 2000 she won the award for Jurisprudence of United States Constitutional Interpretation 1999 revised 2010. Ms. Dowling received a Gilder Lehrman Fellowship 2012-2013 through the New York Historical Society to complete research for this book. She served as Director of the United States Supreme Court Library and was the Associate Librarian for Georgetown University and the University of Missouri-Kansas City. She retired to part-time work as the Senior Projects Librarian at the William and Mary School Law and has taught Legal Research and written book reviews throughout her career.
