Drawing on his expertise in jurisprudence and the work of the legal realists it analyzes the principles that comprise criminal activity with an emphasis on its creation and definition by officials. This process is explored in the chapters on criminology criminal theory and penal theory and in more specific terms the chapters on legality mens rea harm causation punishment strict liability ignorance and mistake necessity and coercion mental disease intoxication and criminal attempt. "For many years our standard work on criminal law has been Bishop's. First published in 1856 Bishop's is the only American book in the field that has conspicuously influenced our criminal law. . When Jerome Hall's General Principles of Criminal Law 1947 appeared it represented the first significant effort to articulate the principles of criminal law since Bishop's era. Reprint of the first English edition based on the 12th American edition with notes on English decisions by W.E. Grigsby. "Probably the decisive factor in our reception of English equity was Story's Equity Jurisprudence. With much art . he made it seem that the precepts established by the decisions of the English Courts of Chancery coincided in substance with those of the Roman law as expounded by the civilians and hence were but statements of universal principles of natural law universally accepted in civilized states. If equity had been expounded to American judges and lawyers and students in the dry and technical fashion of the contemporary English treatises we might have been sorely hampered in the development of American Law by a crippled equity. Story's sympathetic exposition of English equity . was the one thing needed to commend equity to our American courts and to counteract the forces that were working against it." Garner President LawProse Inc. ISBN-13: 9781584771838. ISBN-10: 1584771836. Hardcover with dust jacket. New. $49.95 This book tells how to brief and how to argue a Federal case on appeal. Its primary purpose is to explain to the lawyer how to best persuade a Federal appellate court to decide a case in his favor. It is neither a practice manual nor a text of Federal appellate procedure being written on the assumption that all the procedural steps necessary to perfect the appeal have been or will be timely taken. Consequently this book deals with problems that are common to appeals in whatever Federal court they may be presented. Many of the principles defined and discussed herein are applicable also to the argument oral and written of questions of fact and law presented and heard in Federal trial courts. The task of presenting facts and law effectively the psychology of persuasion the requirements of candor and accuracy-these are matters common to forensic effort in every courtroom at every state of a litigated proceeding. In addition to its discussion of appellate advocacy and a description of procedure in the federal appellate courts Supreme Court U.S. Court of Appeals and specialized federal courts it provides valuable guidelines for writing briefs and appeals and the preparing oral arguments. Among other lessons it teaches ways to -think before writing -state facts and phrase issues persuasively -use argumentative headings -employ clear forceful English -handle questions in oral argument -use maps and charts effectively and -prevent "forensic halitosis." AALS Law Books Recommended for Libraries List 26 Legal Profession page 20 "A" Rated. "To get into court and to maintain your right to be there is the object of all pleading and is as important in an appellate court as in a trial court . This book is a guide to handling of cases on appeal in the Federal courts by one who is eminently qualified to instruct and direct in this field." --from the foreword by Sherman Minton Associate Ju. unknown books

Hardcover. New. $28.95 AN INFLUENTIAL THEORY OF MINORITY RIGHTS "In Calhoun's last years he drafted two essays that set forth his ideas on political theory. The first and shorter essay `The Disquisition on Government' is the more significant in that Calhoun sought to develop a consistent theory of minority rights within the context of majority rule. He urged universal recognition of the inequality of mankind and the differentiation of social and economic concerns. For an organized society to work in a harmonious and practical sense these differences Calhoun contended had to be recognized and then institutionalized. He was of course arguing for his section and its `peculiar institution' but nowhere does he mention slavery in the essay. Calhoun's thought as developed in the "Disquisition" and to a lesser extent in his `Discourse on the Constitution' remains an original contribution to the history of political theory. His assertion of pluralism in political representation has influenced diverse critics of society including liberal supporters of civil rights and conservative defenders of special social and economic interests." --JOHN NIVEN "JOHN C. CALHOUN" American National Biography 4:215-216 Secretary of war and state a two-time vice president and one of the more notable senators in U.S. history JOHN C. CALHOUN 1782-1850 was one of the greatest American statesmen of the nineteenth century. Indeed Walker describes Cowell 1554-1611 as "reputed the most learned civilian of his time." But its publication sparked enormous controversy. At a time when Parliament and crown were vying for power the Commons disapproved of Cowell's monarchical orientation which was evident in such definitions as "King" "Parliament" "Prerogative" "Recoveries" and "Subsidies." When a joint committee of Lords and Councillors reviewed the work the ensuing controversy nearly halted the affairs of government. James I intervened in fear that his own fiscal interests would not be approved by the Parliament and ordered a proclamation that imprisoned Cowell suppressed the book and ordered all copies burned by a public hangman on March 10 1610. Moreover The Interpreter contained a quotation that criticized Littleton's scholarship which alienated and enraged Sir Edward Coke. It comes as no surprise that he was instrumental in the book's suppression and in Cowell's persecution. Walker The Oxford Companion to Law 311. unknown books

Martin an attorney and printer in New Bern North Carolina later a distinguished leader of the New Orleans bar gained distinction for this translation. Known as a source of the French Civil Code 1804 and for its influence on British contract law this treatise led Pothier to write others based on Roman and French law. Marvin quotes and endorses Sir William Jones's assessment of Pothier's treatises and their influence on common law: "For my own part I am so charmed with them that if my undissembled fondness for the study of jurisprudence were never to produce any greater benefit to the public than barely the introduction of Pothier to the acquaintances of my countrymen I should think that I had in some measure discharged the debt which every man according to Lord Coke owes to his profession."
