This reflection on the international protection of refugees is organized around four main themes. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. Mülkiye mezunu, Hukuk Mektebi muallimlerinden Ismail Hakki Bey (Göreli), 1911`de yayinladigi Hukuk-u Idare kitabinda Nizamnamenin köklerini Gülhane Hatti`na kadar uzatarak. "vilayetin merkeze kaviyyen rabti esbabina tevessül edildigini" söylemistir. Iki yil sonra Hukuk Mektebi`nin bir diger müderrisi Mustafa Seref Bey nizamnamenin yayinlanisiyla ilgili daha etrafli açiklamalar yapmisti; "Herseyden evvel inhilal (dagilma) haline gelen kuvve-i merkeziyeyi diriltmek, isyanlarin intilallerin önünü almak için siki bir merkeziyete lüzum ve ihtiyaç vardi. Su lüzum ve ihtiyaç 1281 (1864) tarihli teskilat nizamnamesini vucüda getirdi". Osmanli idare hukuku profesörleri yorumlariyla modern devletin tasraya nüfuz etmesi ile ayrilikçi hareketler arasinda baglantilar kurmuslardi. Söz konusu tespitler, Osmanli moderlesmesinin en önemli açmazlarindan birini teskil etmekteydi. Midhat Pasa, Fuat Pasa ve Cevdet Pasa gibi nizamnameyi biçimlendiren devlet adamlarinin düsünceleri ve eylemleri, sadece Osmanli 19. Yüzyilini degil Cumhuriyetin mülki teskilatini belirlemistir.
