His thesis covers ample ground and many points of view on the subject of freedom of expression including his criticism of Justice Kent that "Blackstone was no authority on free speech" and that the motivation for blasphemy laws was the protection of the privileged classes. New. $34.95 Examines an important and complex period in the history of the laws and customs devised by merchants to regulate their relations with each other and the changes in the law merchant and in negotiable instruments in colonial New York during the years 1664 to 1730 in the context of New York's commercial place in the British Empire. "Economic influences and legal theory combined to form the New York law of negotiable instruments during the colonial period. That the legal theory was an amalgam of Dutch civil law and elementary English common law serves to complicate the situation. Furthermore the unsettled nature of the judicial system during the seventeenth century made consistent legal development fortuitous at best and haphazard at its worst. This fluid state of economic and legal development is as fascinating in its complexity as it is baffling in its inconsistency." Introduction 3. "This brief study of the law of merchant and bills of exchange has as its background a fascinating era of legal history. Changing legal institutions and patterns of trade were typical of these early years. For the student of history as well as the legal scholar these developments are of great significance for they are the basis for the future growth of the law and the commercial supremacy of the province of New York." Preface vii. Herbert A. Johnson is Distinguished Professor Emeritus of Law University of South Carolina School of Law. Ross Alf
On Law and Justice
2012. ISBN-13: 9781584774884; ISBN-10: 1584774886. An Influential Study by a Leading Exponent of Legal Realism Ross Alf. On Law and Justice. Originally published: Berkeley: University of California Press 1959. xi 383 pp. Reprinted 2004 2012 by The Lawbook Exchange Ltd. ISBN-13: 9781584774884; ISBN-10: 1584774886. Hardcover. New. $65. In this influential and oft-cited study Ross discounted the theories of natural law positivism and legal realism. In their stead he proposed the abandonment of "ought-propositions" for the "is-propositions" employed by other empirical sciences thereby envisioning lawyers that serve merely as "rational technologists." Less bound by tradition and traditional notions of justice jurisprudence then becomes "not only a beautiful mental activity per se but also an instrument which may benefit any lawyer who wants to understand what he is doing and why" Preface. "For the realist . the book will be highly encouraging in its indications of the difficulties which a positivist faces in handling realism. Positivists are likely to be concerned with whether Ross has unnecessarily exposed himself to realist attacks. Both Schools will be indebted to Ross." --W.L. Morison 69 Yale Law Journal 1959-1960 1096. Alf Niels Christian Ross 1899-1979 was Professor of Law at the University of Copenhagen. In 1956 he was a visiting professor at the University of Illinois. He served for seven years on the constitutional committee that laid the groundwork for the Danish constitution of 1953. New. $22.95 Reprint of Volume XVII in Probsthain's Oriental Series. With a Chinese index and an index of names and references. The Book of Lord Shang was probably compiled sometime between 359 and 338 BCE. Along with the Han Fei-Tzu it is one of the two principal sources of Legalism a school of Chinese political thought. Legalism asserts that human behavior must be controlled through written law rather than through ritual custom or ethics because people are innately selfish and ignorant. The law is not effective when it is based on goodness or virtue; it is effective when it compels obedience. This is essential to preserve the stability of the State. Roscoe Pound recommended this book for the study of old Chinese law in Outlines of Lectures on Jurisprudence 5th ed. 235. unknown books

Ours is an age of growing doubt about constitutional theory and of outright hostility to any theory that defends judicial review. Why should a tiny number of unelected judges be able to validate or invalidate laws on such politically controversial issues as abortion religion gender and sex - or even determine how the president is elected In this provocative book a leading constitutional theorist offers an entirely original defense of judicial review. Louis Michael Seidman argues that judicial review is defensible if we set aside common but erroneous assumptions - that constitutional law should be independent from our political commitments and that the role of constitutional law is to settle political disagreement. Seidman develops a theory of "unsettlement." A constitution that unsettles that destabilizes outcomes produced by the political process creates no permanent losers nursing deep-seated grievances he says. An "unsettling" constitution helps to build a community founded on consent by enticing losers into a continuing conversation. The author applies this theory to an array of well-known cases heard by the Supreme Court over the past several decades including the fall 2000 election decision. unknown books

New. $23.95 The large number of sophisticated legal references in Shakespeare's work and his association with the Inns of Court led many to conclude that he was once a barrister clerk or law student. This idea took root in the late eighteenth century and reached fruition in such works as Shakespeare A Lawyer 1858 by William L. Rushton and Shakespeare's Legal Acquirements Considered 1859 by John Campbell both are available as Lawbook Exchange reprints. Devecmon refutes this view arguing that the Bard's knowledge was that of a well-read layman. "Mr. Devecmon boldly announces himself a disbeliever in the lawyer theory and his little book is a strong argument on that side. It shows careful research is written in terse vigorous style and exhibits much legal learning." 60 Albany Law Journal 241 1899-1900. unknown books

New. $69.95 Reprint of the uncommon first edition. As much a treatise as it is a handbook which gives this book more than historical value it examines the nature of taxation and sources of the power to impose taxes. Contents include "The Construction of Tax Laws" "Taxation by Special Assessment" "The Remedies of the State Against Collectors of Taxes" "Local Taxation under Legislative Compulsion" and "The Remedies for Illegal and Unjust Taxation." "The work is not a mere treatise upon tax titles but is rather a profound statesman-like and judicial treatise upon the sources of the power of taxation and the proper subjects upon which it may be exerted as well as the legitimate mode of its exercise. Judge Cooley has discussed the various questions connected with the subject in the light of principle and has presented with clearness and cogency the reasons underlying them as well as the authorities in their support. . In other words the author shows the principles whereon the successive steps of taxation rest whatever may be the particular language of any statute respecting the same. The plan and execution of the work is a happy blending of the philosophical and practical and the book must meet with a general and abiding approval as well as with a cordial and generous reception." -- Western Jurist 10 1876 255. Thomas McIntyre Cooley 1824-1898 was the most important American jurist of the late-nineteenth century. One of the first three professors in the law department of the University of Michigan he was elected to the Michigan Supreme Court in 1864 and served as its leading justice for twenty years. He was a prolific author. His 1868 Treatise on the Constitutional Limitations Which Rest Upon the Legislative Power of the States of the American Union was his most important work. It went through six editions by 1890 and was cited more often that any other legal text in the late nineteenth century. His support for Grover Cleveland in the 1884 and 1892 elections contributed to his 1887 appointment by Pre. unknown books

Our present system of criminal prosecution originated in England in the sixteenth century. Langbein traces its development which was at its most intense during the reign of Queen Mary. He shows how the common law developed a system of official investigation and prosecution that incorporated the medieval institution of the jury trial. He places equal emphasis on the role of the justices of the peace as public prosecutors. The second half of the book compares the English system with those of the Holy Roman Empire Germany and France. He concludes by refuting the popular opinion that the English were strongly indebted to continental models. This work was awarded Cambridge University's Yorke Prize. unknown books
