New. $18.95 "Judge Phelps of Baltimore has done a very pretty piece of legal and literary work in this volume. The text is Falstaff's remark in the Gadshill scene: `An the Prince and the Poins be not two arrant cowards there's no equity stirring." All the commentators have passed this over assuming it seems that the meaning is only `there's no such thing as justice in the world.' Certainly the words will bear that meaning. But it is a flat remark for Falstaff to make if that is all. Is it not really pointed by some special allusion Putting that question to himself as a good Shakespeare reader Judge Phelps as a good lawyer answers it by looking to what was happening in the Courts just before the first part of Henry IV was produced. That was some time in 1597 probably near the end of the year. It turns out that equity was stirring very much in 1596-7.": F.P. The largest is a thorough topic-by-topic analysis of the Digest or Pandects the vast compilation of jurisprudential writings from the Corpus Juris Civilis. This is complemented with a running demonstration of each topic's relevance in contemporary European law. Reprint of first edition. Parry 1863-1953 was an English municipal judge for over twenty years. His book a guide for "the man in the street" which began as a series of newspaper articles outlines the laws concerning insolvency debt and poverty. It is distinguished by its emphasis on cultural attitudes toward the poor and its readability and humanity. Parry's was among the strong voices to speak in sympathy to the poor in response to the Poor Law Amendment Act which had been enacted in 1834. "Judge Parry is particularly gifted with that rare imagination which enables him to see mortal men and women where others see cases litigants and parties before the courts. Hence his volume is a rare document especially useful as a corrective to the tendency to lose sight of actual living conditions in the logical pursuit of abstract legal doctrines." Discusses the practice and methods of the amendment and revision of state constitutions and the legal principles rather than theories which precede such alterations. An examination of the first state constitutions from 1776-1783 provides a historical context but much of the work analyzes the relevant legal principles affecting changes to state constitutions based on a study of judicial decisions pertinent to such areas as the development of the distinction between constitutions and statutes and the distinction between the constitutional convention and the regular legislature in states. Includes a Table of cases and an appendix by state showing popular votes on constitutional questions from 1899-1908. unknown books‎

Arguably his most important work Principles of International Law was published after Kelsen's retirement from the University of California at Berkeley in 1952. It is an important synthesis of Kelsen's earlier work on international law and jurisprudence. "Any contribution by Professor Kelsen to international law is always welcome. This certainly applies to the book under review. . It is a model of precision and clarity and . a stimulus to thought. If for no other reason this introduction to international law is an outstanding and fully successful attempt-of which there are but few-to present the entirety of the international law of peace within the framework of a jurisprudential system.": Hersch Lauterpacht British Yearbook of International Law 29 1952 509 513. Standards of American Legislation: An Estimate of Restrictive and Constructive Factors. Originally published: Chicago: University of Chicago Press 1917. xx 327 pp. Reprinted 2006 2010 by The Lawbook Exchange Ltd. ISBN-13: 9781584775522; ISBN-10: 1584775521. Hardcover. New. $26.95 This book originated as a series of lectures presented at Johns Hopkins in 1915. It proposes a method to supplement the established doctrine of constitutional law which enforces legislative norms through negation and review by a system of positive principles that would guide the making of statutes and give more definite meaning and content to the concept of due process. Highly regarded since its original publication in 1917 and the winner of Harvard Law School's Ames Prize in 1919 it went on to become a standard work. It was recommended to cite two examples in Roscoe Pound's Introduction to American Law 1919 and Arthur Vanderbilt's Studying Law 1945. A comment published at the end of Freund's career summarizes the general opinion of the field: "The great quality which Ernst Freund brought to the study of administrative law was his capacity for analysis. He was the Austin of the jurisprudence of administrative law.": W.I.J. Law Quarterly Review 49 1933 588. unknown books‎

‎An Essay On Judicial Power and Unconstitutional Legislation Being.‎

‎2005. ISBN-13: 9781584775348; ISBN-10: 1584775343. Coxe Brinton. An Essay On Judicial Power and Unconstitutional Legislation Being a Commentary on Parts of the Constitution of the United States. Originally published: Philadelphia: Kay and Brother 1893. xvi 415 pp. Reprinted 2005 by The Lawbook Exchange Ltd.ISBN-13: 9781584775348; ISBN-10: 1584775343. Hardcover. New. $95. Coxe's main argument is that the "Constitution contains express texts providing for judicial competency to decide questioned legislation to be constitutional or unconstitutional and to hold it valid or void accordingly" 4. There are four subordinate arguments: First that the framers of the constitution specifically granted the courts the power to hold a law unconstitutional by dint of the Supremacy Clause and by Article III Section 2 defining judicial power. Second that documents written before the constitution were influential in framing the text and establishing the idea of judicial review. The third looks at the era before and during the confederation with an eye toward the court's power to rule on constitutionality. The fourth argument finds analogies and precedents in foreign law including Roman and Canon law. unknown books‎

Tending to Illustrate the History and Practice of Prize Law. London: W. Wilson 1801. viii viii 213 1 pp. Reprinted 2006 by The Lawbook Exchange Ltd. ISBN-13: 9781584776567; ISBN-10: 1584776560. Hardcover. New. $85. Reprint of the only edition. Robinson 1766-1833 a doctor of civil law an advocate of Doctor's Commons and the editor of an important series of admiralty reports argues that prize law is governed by body of principles derived from the "immemorial usage and Customs of the Sea" iii that were revealed over time in treaties and other legal documents. He supports his argument through annotated excerpts from the Consolato del Mare and other English and Continental documents from the fourteenth through eighteenth century in translation. It is an interesting thesis argued with a sophisticated blend of ideas from the civil and common law. From a historical point of view Robinson's remarks on landmark texts on prize law offer important insights into their English reception at the dawn of the Napoleonic Wars. unknown books‎

‎Osiel Mark J.‎

‎Mass Atrocity Ordinary Evil and Hannah Arendt: Criminal Consciousness‎

‎2001. ISBN-13: 9780300087536; ISBN-10: 0300087535. Osiel Mark J. Mass Atrocity Ordinary Evil and Hannah Arendt: Criminal Consciousness in Argentina's Dirty War. New Haven: Yale University Press 2001. viii 257 pp. Cloth hardcover in dust jacket. New. ISBN-13: 978-0300087536; ISBN-10: 0300087535. Publisher's Price USD 58. Special $25. Osiel uses the case of Argentina's Dirty War of the 1970s to address Arendt's controversial argument that the highly bureaucratized nature of state-sponsored crime creates an atmosphere in which its perpetrators are not really aware of their wrongdoing. Is it possible that the soldiers of mass atrocities - Adolph Eichmann in Nazi Germany and Alfredo Astiz in Argentina's Dirty War for example-act under conditions that prevent them from recognizing their crimes In the aftermath of catastrophic state-sponsored mass murder how are criminal courts to respond to those who either gave or carried out the military orders that seem unequivocally criminal This important book addresses Hannah Arendt's controversial argument that perpetrators of mass crimes are completely unaware of their wrongdoing and therefore existing criminal laws do not adequately address these defendants. Mark Osiel applies Arendt's ideas about the kind of people who implement bureaucratized large-scale atrocities to Argentina's Dirty War of the 1970s and he also delves into the social conditions that could elicit such reprehensible conduct. He focuses on Argentine navy captain Astiz who led one of the most notorious abduction squads to discover how he and other junior officers could justify the murders of more than ten thousand suspected "subversives." Osiel concludes that legal stipulations labeling certain deeds as manifestly illegal are indefensible. He calls for a significant change in the laws of war to preserve both justice and the possibility of dialogue between factions in such sharply divided societies as Argentina. Osiel's proposals have profound implications for future prosecutions of Pinochet's lieutenants Milosevic's henchmen the willing executioners of Rwanda and East Timor and other perpetrators of state-endorsed murder and torture. unknown books‎

‎2004. ISBN 9781584773832; ISBN 1584773839. Cottu Charles. On the Administration of the Criminal Code in England and the Spirit of the English Government. Translated Exclusively for the Pamphleteer. Originally published: London: Pamphleteer Volume XVI Number 31 1820. 152 pp. With "M. Cottu Criminal Law of England" Quarterly Review 1820. 18 pp. Reprinted 2004 by The Lawbook Exchange Ltd. ISBN-13: 9781584773832. ISBN-10: 1584773839. Hardcover. New. $29.95 Reprint of the first English edition. Cottu 1777- was a counsellor of the Royal Court of Paris and Secretary-General to the Royal Society of Prisons. In 1820 he was sent by his government to observe the English criminal courts. He returned with a vivid description of a system that had changed little since the days of Coke and Pulton. As Langbein describes it "the whole of the criminal trial was expected to transpire as a lawyer-free contest of amateurs. In cases of felony. the prosecution was also not represented by counsel. The victim of the crime commonly served as the prosecutor. In homicide cases either the victim's kin prosecuted or the local coroner stood in. Just as Blackstone summarized the common law on the cusp of its transformation by modern capitalism Cottu described a system of criminal procedure that was about to be transformed into the system we recognize today. This work was originally published in the periodical The Pamphleteer. It was reissued as a book in 1822 with the title On the Administration of Criminal Justice in England. Langbein The Origins of Adversary Criminal Trial 11. Cottu is noted as one of Langbein's primary sources. A contemporary 18-page review of the French edition is appended to this work. unknown books‎

Originally published: London: John Murray 1915. xxviii ii 578 pp. Reprinted 2005 2014 by The Lawbook Exchange Ltd. ISBN-13: 9781584775737. ISBN-10: 1584775734. Hardcover. New. $39.95 The authors argue that the First World War effectively ended the existing system of international law a system that was already in decline due to the growing economic and political interdependence of states. These changes have created a new set of problems that will provide the basis of a new system of international law when the war ends. In addition to supplying an intellectual framework for this new system Baty and Morgan address practical topics such as international arbitration and more abstract issues such as the clash between nationalism and cosmopolitanism. "Very good reading. It is a thoughtful book." --T.S.W. Yale Law Journal 19:313-314. Thomas Baty 1868-1954 an English lawyer traitor and transgender pioneer was one of the most intriguing individuals in the field of twentieth-century international law. A leading expert and prolific scholar who taught at Oxford University and was a joint secretary of the International Law Association he secured his reputation with the publication of this work and earlier International Law 1909. At the same time he lived a parallel private life as Irene Clyde and helped to found and was the editor of Urania the pioneering anti-gender magazine of the 1900s. In 1916 he became a legal advisor to the Japanese foreign ministry. His legal opinion did much to "justify" Japan's invasion of Manchuria in 1931. At the outbreak of war in 1939 he chose to remain in Japan and continued to advise the government even after Pearl Harbor and Japan's declaration of war against the U.S. and Britain. His last legal paper appeared in the English-language journal Contemporary Japan in 1944. J.H. MORGAN 1876-1955 was a Liberal candidate for Parliament in 1910. Influenced by the Utilitarian philosopher Jeremy Bentham Mill adopted a modified laissez-faire position believing in the efficiency of free enterprise but aware of the frequent failure of the market to maximize utility. Later refining this stance he argued that the promotion of happiness is a moral duty though he made a clear distinction between desirable and undesirable forms of pleasure. These ideas had a decisive influence on Mill's classic 1859 essay perhaps the most celebrated defense of individual freedom and self-protection based on utilitarian values rather than natural right to appear in English. JOHN STUART MILL 1806-1873 was an English philosopher whose works made significant contributions to individualistic liberal political thought. He worked for the East India Company and was a Member of Parliament for one term. With the adoption of the Constitution the original states lost their right to settle disputes between themselves by means of war. Harriman enlarges this discussion to the United States' place in the world and the maintenance of its independence following the Treaty of Versailles in 1919. Written in 1925 Harriman offers a thorough organized treatment of the extent of the legal consequences in which the Constitution of the United States may be affected by the Treaty of Versailles and the United States' resulting membership in the League of Nations and the Permanent Court of International Justice. He presents his study with this statement: "The Constitution is at the cross roads. In one direction leads the way of national tradition and absolute independence; in the other the way of surrender of absolute independence of action in some degree to a federation of the world." The most impressive contribution to the bibliography of Anglo-Saxon legal sources since Thorpe and Liebermann this edition contains the texts of the Kentish laws the laws of Ine and Alfred the Great treaties with the Danes and the laws of Edward the Elder and Aethelstan. The texts are in Anglo-Saxon with English translations. Latin texts are used if the Anglo-Saxon originals were lost. "Mr. Attenborough has done a very useful work in providing a critical translation of the Anglo-Saxon dooms for English-speaking students who are unable or do not go far enough to find it needful to make use of Liebermann's great and apparently final edition. Not that advanced scholars can afford to neglect Mr. Attenborough for he shows himself fully capable of independent judgement and makes many observations deserving their attention": Frederick Pollock Law Quarterly Review 38 1922 511. Translated From the Original French by Mrs. Madeleine Vinton Dahlgren. Originally published: Lancaster: Inquirer Printing and Publishing Company 1874. xvii 19-288 15 pp. Reprinted 2004 by The Lawbook Exchange Ltd. ISBN-13: 9781584774020; ISBN-10: 1584774029. Hardcover. New. $95. With a preface by James A. Garfield. Like Tocqueville the Marquis de Chambrun 1831-1891 was fascinated by the United States and its government. He also shared Tocqueville's belief that the United States is a testing ground for the forces shaping the modern world. Chambrun's study of the federal government's executive branch offers a number of interesting observations. He doubts the value of the vice-presidency and argues that quadrennial elections promote liberty by creating momentary periods of political instability. He offers equally interesting observations on such topics as the Civil War the impeachment of President Johnson and the relationship between the Executive Legislative and Judicial branches. unknown books‎
