New. $19.95 An Eye for an Eye was Darrow's only fictional work aside from his autobiographical novel Farmington published in 1904. It tells the story of Jim Jackson who struggles with poverty and harsh circumstances before finally murdering his wife in a fit of rage. Faced with the gallows Jackson confesses: "If ther'd been forty scaffolds right before my eyes I'd have brought down the poker just the same." Darrow's novel is a sociological polemic which foreshadows such later works as Theodore Dreiser's An American Tragedy and Upton Sinclair's The Jungle. Abe Ravitz in his Clarence Darrow and the American Literary Tradition 1962 observed that An Eye for an Eye was worthy of a trophy not only for sociological veracity but also for genuine literary achievement. unknown books

This argument was widely held until the late 1950s when it was gradually undermined by later research much of it stimulated by Beard's work. Although most scholars today see the origins of the revolution in terms of the history of ideas especially republicanism Beard's work remains fundamental and has insured a continued focus on the economic aspect of the nation's establishment as well as a wider awareness of the role of economic interests in history. "Dr. Meiklejohn in a book which greatly needed writing has thought through anew the foundations and structure of our theory of free speech . . . he rejects all compromise. He reexamines the fundamental principles of Justice Holmes' theory of free speech and finds it wanting because as he views it under the Holmes doctrine speech is not free enough. In these few pages Holmes meets an adversary worthy of him . . . Meiklejohn in his own way writes a prose as piercing as Holmes and as a foremost American philosopher the reach of his culture is as great . . . this is the most dangerous assault which the Holmes position has ever borne." --John P. Private International Law and the Retrospective Operation of Statutes: A Treatise On the Conflict of Laws and the Limits of Their Operation in Respect to Place and Time. Translated With Notes by William Guthrie. With an Appendix Containing the Treatises of Bartolus Molinaeus Paul Voet and Huber. Originally published: Edinburgh: T. & T. Savigny 1779-1861 was an important German jurist and an excellent scholar of Roman law. A principal member of the historical school of jurisprudence he had a keen interest in its role in the subsequent development of European law. Private International Law is a volume drawn from his System of Modern Roman Law 1840-1849 an eight-volume study of contemporary legal systems based on Roman law. As the translator observes this volume is valuable because it "deals with a subject of great practical importance as to which the opinions of foreign jurists have always been respected in the British courts. And not only has the eighth volume itself been cited as an authority in our tribunals but English writers have borrowed and enforced its doctrines with more or less exactness of reproduction" Introduction 9. Beyond its lucid exposition of a complex subject this book offers a wonderful introduction to Savigny's monumental study. With an appendix containing a biography of Savigny and an index of English and Scottish cases. unknown books

The foundation of the modern international law of war it served as the model for several European military codes and was an important source for the second and fourth Hague Conventions 1899 1907. It was an authority during the Nuremberg and Tokyo war crime trials. Its use by the framers of the 1998 Rome Treaty which established the International Criminal Court demonstrates its lasting value in our time. Hardcover. New. $125. Reprint of the sixth edition. Also known as the law merchant consuetudinary law or somewhat anachronistically commercial law lex mercatoria is a system of customary law that developed in the European commercial community during the middle ages to regulate the dealings of mariners and merchants. Although lex mercatoria fell out of use during the seventeenth and eighteenth centuries many of its principles were incorporated into the common law. They would later provide the foundation of the U.S. Uniform Commercial Code. Beawes fl. 1775 was a merchant and his book as indicated by its title was intended to revive the lex mercatoria. Intended primarily as "a guide to all men in business" this book was nevertheless often cited by lawyers and its authority formed the basis of several decisions. It was especially influential in the United States where according to Kent's Commentaries on American Law it was considered "an authority in mercantile customs" III:126. The first edition of this book was published in 1751. Our reprint is of the sixth edition which has considerable additions by Thomas Mortimer 1730-1810 an expert on finance and commercial law. unknown books

Beard's first book in which he points out that the office of the justice of the peace was originally a creation of the Crown traces the struggle of the office to establish its independence. "It was the King's Peace that after many ages swallowed up every other 'peace' and it is as a phase of the prolonged struggle for mastery between the principle of centralized administration and the principle of local independence that we must view the evolution of the office of Justice of the Peace. This is well brought out by Dr. Beard and he is especially clear in tracing the long series of tentative steps and experiments that led up to the final establishment of the office by the statute of 1360."
