In 1662 Samuel Pufendorf 1632-1694 was appointed to the first modern professorship in natural law at the University of Heidelberg. In 1670 he became professor of natural law at the University of Lund in Sweden. First published in 1672 this is his principal work and a landmark in the history of natural and international law. It proposed a thorough system of private public and international law based on natural law. Beginning with a consideration of fundamental legal ideas and their various divisions Pufendorf proceeded to a discussion of the validity of customs the doctrines of necessity and innate human reason. The work is significant in part because it developed principles introduced by Grotius and Hobbes. Unlike Hobbes Pufendorf argued that peace not war was the state of nature and he proposed that international law was not restricted to Christendom. unknown books

New. $27.95 Stimson wrote this study in response to the rapid development of constitution law that took place around the turn of the century which he attributes to the social impact of modern industrial capitalism. He notes that the enormous volume of cases regarding "obligation of contract" and "commerce among the states" indicates a general shift in the field from cases dealing with the federal constitution or individual state constitutions to cases involving several constitutions. This book was conceived as a guide to this new terrain. It continues to be an excellent comparative study of the federal and state constitutions. It is more that a series of comparisons however. As its title suggests Stimson includes a history of the provisions in each constitution and their origins. "A Valuable piece of work.in the field of legal and constitutional investigation." Its selection of texts from the two testaments forms a corrective to the notion that the alleged inferiority of the place of woman in life is to be debited to the Old Testament alone. New. $25.95 A Comprehensive History of the Tariff System in the United States Goss shows that the tariff system assumed one of three forms during its history that often existed simultaneously: protective preventive and punitive. From an ineffective colonial system that allowed importers to avoid payment through extended credit arrangements to a somewhat less troubled system that demanded immediate cash payments in the early 1840s to a punitive system designed to stymie smugglers during the Civil War the collection of tariff duties was always problematic. This problem became more acute in the wake of industrialization and protectionism a period when direct taxes began to supplant indirect taxation as the major source of government finance. Reviewing the history of American tariff regulation Goss discerns a gradual process towards "more stringent supervision regulation and control" 88. Originally published in the series Studies in History Economics and Public Law edited by the Political Science Faculty of Columbia University. John Dean Goss b. 1869 was a judge in Wisconsin. He later moved to Oregon where he established a legal practice. unknown books

Reprint of the final revised and expanded edition. Especially significant because it had a direct influence on legislation this "Bible of the Reformers" is a model of investigatory pamphleteering in the cause of representative democracy. The long struggle to transform Great Britain into a modern state was effected primarily through the gradual expansion of the electorate which was accomplished though the Reform Acts of the nineteenth and twentieth centuries. In the earlier era as the growth of industry shook the traditional agrarian economy dominated by the landholding aristocracy the accompanying campaign to transform government by weaning power from traditional loci was conducted through a mass of books pamphlets and other printed matter. The Extraordinary Black Book which went through several editions between 1820 and 1832 was the most important of these. As the editor explained: "Government has been a corporation and had the same interests and the same principles of action as monopolists. It has been supported by other corporations; the Church has been one the Agriculturists another the Boroughs a third the East-India Company a fourth and the Bank of England a fifth: all these and interests like these constituted the citadel and out-works of its strength and the first object of each has been to shun investigation. We have however rent the vail." Advertisement to the New Edition iv-v. The Kentucky Resolutions anonymously authored by Thomas Jefferson 1743-1826 were adopted by the Kentucky legislature in 1798. Written to oppose the passage of the Alien and Sedition Acts they initiated a debate about the respective powers of the federal government and states. The most remarkable claim advanced by the resolutions was that states had the right to nullify federal legislation. A key text for advocates of states' rights the resolutions had a profound effect on the debates that led to the Civil War. Dudley a Kentucky attorney provides a lively account of their history. In contrast to other authors which tend to focus of Jefferson Dudley emphasizes the central role played by John Breckinridge the leading member of the Kentucky House of Representatives. Indeed this book which draws extensively on his papers remains the principal study of Breckinridge's influence on the resolutions. unknown books

New. $34.95 This volume collects two important early accounts of the infamous Salem witchcraft trials based on primary sources. Published in 1693 Wonders of the Invisible World by Cotton Mather is an account of selected trials written at the request of the judges who wished to address claims of impropriety. Though he believed in witchcraft Mather was critical of the judges' conduct when the trials were underway. After reading the transcripts however he concluded that the verdicts rested on ample evidence according to the standards of English and American law. Published in 1700 More Wonders of the Invisible World Or The Wonders of the Invisible World Displayed by Robert Calef attacked Mather's account. Skeptical about the existence of witchcraft he argued for the injustice of the trials and suggested moreover that Mather influenced the judges and public opinion. A well-documented and devastating account it was the first important publication to show that the trials were a miscarriage of justice. SAMUEL F. FOWLER 1800-1888 was a member of the Massachusetts Constitutional Convention held in Boston in 1853. He is the author of An account of the life character &c. of the Rev. Samuel Parris of Salem Village and of his connection with the witchcraft delusion of 1692 1857. Fowler's library was recognized for its breadth of works related to witchcraft and American history. COTTON MATHER 1662-1728 the son of Increase Mather took over for his father as Pastor of the Old North Church in Boston in 1685. Mather is known for his founding role in the Salem witchcraft trials. ROBERT CALEF 1648-1719 a member of the Baptist Church in Boston denounced the Salem witchcraft trials and in particular criticized Mather's zeal in promoting the trials. unknown books

Married Women's Property Act 1882. U.K. Robert George Printed Act of Parliament. Unbound and stitched. In fair condition on aged paper. Ownership signature of 'R. G. Underdown' Railway General Manager at head of first page. Passed 18 August 1882. The ten pages of the act are preceded by a two page 'Arrangement of Sections' from '1. Married women to be capable of holding property and of contracting as a feme sole.' to '27. Short title.' A document of considerable historical significance. Scarce: no copies located on COPAC.

The Married Women's Property Act 1882 45 & 46 Vict. c.75 was an Act of the Parliament of the United Kingdom that significantly altered English law regarding the property rights of married women which besides other matters allowed married women to own and control property in their own right. English law defined the role of the wife as a feme covert emphasizing her subordination to her husband. Upon marriage the husband and wife became one person under the law as the property of the wife was surrendered to her husband and her legal identity ceased to exist. Any personal property acquired by the wife during the marriage unless specified that it was for her own separate use went automatically to her husband. Women were often limited in what they could inherit. Males were more likely to receive real property land. The Married Women's Property Act 1882 altered the common law doctrine of coverture to include the wife's right to own buy and sell her separate property.8 Wives' legal identities were also restored as the courts were forced to recognize a husband and a wife as two separate legal entities. unknown books

Louisiana: Mississippi River: Law John
LOUISIANA BY DE RIVIER MISSISIPPI
Amsterdam 1720. Single-sheet map 9 3/4 x 7 3/4 inches. Minor foxing. Near fine. A scarce early map of the Mississippi River Valley depicting the American region between the Gulf of Mexico and the Great Lakes taken from HET GROOT TAFEREEL DER DWAASHEID. THE GREAT MIRROR OF FOLLY a scathing account of the speculative crashes that led to European financial disaster in 1720. The work was a chronicle of the failed attempts by John Law Controller General of Finances for the French government to open Louisiana to trade in order to help alleviate France's financial problems. This led to the creation of the Mississippi Company which created the "Mississippi Bubble" incident that destroyed the Banque Générale Privée the General Private Bank which Law founded. The map depicts the Mississippi River parts of Louisiana and Florida Lake Michigan referred to here as "Lac de Illionis" and Lake Superior the extent of French colonial explorations in the region and names of Indian tribes. It is decorated with a title cartouche incorporating the arms of John Law and depicting two Native Americans holding a cornucopia through which flows the mighty Mississippi River. unknown books

The German edition of Olmsted's JOURNEY THROUGH TEXAS one of the best travel books for pre-Civil War Texas or indeed the United States. The first German edition of this book appeared in 1857. Olmsted spent considerable time among the German settlements in Texas and is lavish in his praise of them; otherwise he found Texas primitive and backward. Militia Law
MANUSCRIPT CONSTITUTION FOR A LOCALLY- ORGANIZED MILITIA UNIT
Probably New York State 1837. 4pp. manuscript on a folded folio sheet. Vertical and horizontal folds. Tanned and stained. Neat splits along the center horizontal folds with no loss of text. Good overall. An original manuscript putting forth the constitution and articles for a local militia unit. The manuscript is written out as a blank form with no particular militia company state or locality identified. Presumably this text was copied and circulated as a guide to all those interested in forming a militia. One part of the text refers to an "Act of Assembly approved April 4 1837." The State of New York passed a revisal of the state militia law on that date making it the most likely location.

A calligraphic hand has written at the top of the first page "Constitution of the" with a blank space underneath. The preamble then reads: "The subscribers hereunto are hereby united in the formation of a volunteer company of Infantry or Riflemen as may be determined hereafter by a vote of two thirds of the members. The company shall be governed by constitutional law and the following articles of association." The manuscript text then goes on to list twenty- six articles that would govern the company including a description of their dress and "undress" uniforms rules for appointing "non- commissioned" officers and majority rule of the "regular parading members" in decision- making. There would be a treasurer and a secretary regular fees fines as appropriate and new members would have to be proposed by a current member and then would be voted upon by the whole company. Provision is also made for the future maintenance of an armory building.

Interesting evidence of military organization at the local level in 19th- century America. unknown books
